When Cal/OSHA issues a penalty, or notices of violations, employers may file an appeal. There are several affirmative defenses that an employer may raise when filing the appeal. This talk will focus on one such affirmative defense: the Independent Employee Action Defense. The Independent Employee Action Defense is nuanced, and has several specific elements that an employer must prove in order to be successful. In discussing the Independent Employee Action Defense, this talk will cover the required elements, provide examples from prior appeals of employers successfully raising this affirmative defense, and highlight practices and procedures that employers can implement to better prepare themselves to raise this affirmative defense in the event of a Cal/OSHA citation.
